Regarding Florida Statute Chapters
Chapter 697- The
Nature of a Mortgage: Mortgages are more numerous than deeds
of trust, and witnesses are not required for the creation of
a mortgage.
Chapter 698- Chattel Mortgage: The title is not
transferred in the mortgage. The debate of title transfer
only occurs in the case of default.
Chapter 701- Assignment and Cancellation of
Mortgages: Florida is unique in regards to mortgage
satisfaction in that its laws are much harsher than other
states. If the lender does not issue a satisfaction
certificate within sixty days of the final payment of the
loan, he/she has committed a second-degree misdemeanor.
Chapter 702- Foreclosure of mortgagee, Agreements for
deeds, and Statutory Liens: All foreclosures, except
multifamily property of more than four units, are foreclosed
judicially, and in equity. The foreclosure takes place in
court, and without a jury. |
